    Hi,

I've recently moved house and I'm trying to set up my new garden. I'm very new to gardening and really only interested in things that I can grow to eat lol!!!

Anyway. At the bottom of my garden I have about three or four small trees (holly etc) that I would really like to replace with fruit trees. Am I allowed to just remove the trees and replace them or do I have to consult anyone first???

    Many Thanks

If trees have a preservation order on them then you have to leave them alone.

Holly trees are unlikely to have any such order in place-you should have been made aware of any covenant stopping you from doing whatever you like in your garden-so go ahead-I would

    Good growing

You don`t normally have to have any permission to remove trees or shrubs that are growing in your own garden.
Before digging them out though, I`d cast a thought as to why holly trees might be planted there in the first place. eg Are they forming a wind-break, screening out an ugly view, or maybe keeping out some "undesirables", either animal or human?

As others have said, they may have a TPO (tree preservation order) on them. Also, if you live in a conservation area, there are restrictions on what you can do. The best thing would be to contact your local council's tree officer and check, to avoid a possibly hefty fine.

Thanks everyone. We had a lot of issues with covenants etc during the move so I'm fairly confident that there isn't a problem from that side of things.

I do think that the trees were put there to provide some privacy between our house and the one at the bottom of the garden. I would hope that the fruit trees will provide the same amount of privacy.

I think I'll do as you've suggested and contact the council just to be on the safe side.

    Many thanks smiley - smiley

I'd hang back on the holly to see if it bears berries, it would be a shame to have the birds go without a snack during winter., Cheers, Tony.

I know where you're coming from, I love the idea of using the leaves in decorations at Christmas - but it comes down to space and I love to make jam and preserves and I can only fit in the fruit trees if I replace the trees that are already there.

I had considered trying to move the holly tree to the front of the house but I know it's not possible due to it's size.

I'll look after the birds though - they won't starve smiley - winkeye

It's not just a TPO you need to check, I live in a conservation area and need planning permission to make any chnages (even just trim) trees in my garden- front or back.
