Man will not face retrial in judge road death case

A man previously accused of causing a judge鈥檚 death as he crossed the road will not face a retrial, the Crown Prosecution Service (CPS) has confirmed.
District judge Matthew Mawdsley, from Manchester, suffered fatal injuries on the A38 Aston Expressway in Birmingham in December 2022.
Elliot Nash, 33, went on trial accused of causing death by driving while uninsured but a jury failed to reach a verdict in February and the case was adjourned.
The CPS has since decided that Nash will not face a new trial after speaking to Mr Mawdsley鈥檚 family and the police.
A CPS spokesperson said: 鈥淥ur thoughts remain with the family of Matthew Mawdsley following his tragic death in 2022.
鈥淲e have carefully considered the outcome of the trial and after speaking to Mr Mawdsley鈥檚 family and the police we have decided not to seek a retrial.鈥
Nash, of Cedar Park Road in Willenhall, Walsall, previously pleaded guilty to driving without insurance and failing to stop at the scene of a road traffic accident, the CPS said.
He is due to be sentenced for those offences at Birmingham Crown Court on 12 April.
Mr Mawdsley died after he was hit by a number of vehicles when he tried to cross the A38 Aston Expressway at about 22:00 GMT on 16 December 2022.
He had been appointed to his role as district judge in Birmingham just weeks earlier and was returning to his hotel after a Christmas celebration with colleagues.
