DMs Are Open: Privacy Notice

Your trust is very important to us. This means the 大象传媒 is committed to protecting the privacy and security of your personal data. It is important that you read this notice so that you are aware of how and why we are using such personal data. This privacy notice describes how we collect and use personal data about you during and after your relationship with us, in accordance with data protection law.

Why are we doing this and how can you participate?

The 大象传媒 is producing a new open submissions show to develop new comedy writers/performers. Submissions can be based on what’s happened that week, month or even so far this year so long as the sketches or jokes are funny and feel relevant to contemporary popular culture.

You can participate by uploading written/audio material each week to be considered for use on the show. The material must be your own work and any audio should only include your solo voice. For all contributions that appear on the show, a flat fee will be paid to you depending on the type of material used.

The 大象传媒 will collect your personal data via an online platform used by the 大象传媒.

When you contribute to the 大象传媒, we may use your contribution in our programmes or content, but we cannot promise to use everything that we receive. If we broadcast your contribution, this may include the programme being available online and/or on demand, and your contribution may be used again in a future broadcast. It may also include use on the 大象传媒’s social media channels.

What personal data will 大象传媒 collect and how will we use it?

The 大象传媒 will collect and process the personal data for the purposes of making DMs Are Open. There are two types of personal data: personal data and special category data. Special category data is still personal data, but its processing by the 大象传媒 requires the 大象传媒 to follow additional compliance steps.

Personal data:

You must 18 years or older to participate in DMs Are Open.

The 大象传媒 will collect and process the following personal data about you:

• Your first and last name
• Email
• Telephone number
• Your written material
• Your audio material
• Confirmation that you are over 18 years old

If your contribution is selected to appear on the show, we will also collect the following personal data to pay you your fee:

• Bank account details
• National insurance number
• Postal address

The 大象传媒 may also process special category data depending on the content of your submission to us. This might include for example:

• Racial or ethnic origin
• Religious or philosophical beliefs
• Political opinions
• Health information
• Sexual orientation

Who is the Data Controller?

The 大象传媒 is the “data controller” of your personal data. This means that the 大象传媒 decides what your personal data is used for, and the ways in which it is processed. For the avoidance of doubt, your personal data will be collected and processed solely for the purposes set out in this privacy notice. As the data controller, the 大象传媒 has the responsibility to comply, and to demonstrate compliance with, data protection law.

Lawful basis for processing your personal data

The lawful basis on which the 大象传媒 processes the personal data is the performance of its public task. The lawful basis on which the 大象传媒 processes your special category data is substantial public interest. The 大象传媒’s role is to act in the public interest and to serve all audiences with content which informs, educates and entertains. This is consistent with the 大象传媒’s wider public purposes under its Royal Charter in which the 大象传媒 must:

“... show the most creative, highest quality and distinctive output and services: the 大象传媒 should provide high-quality output in many different genres and across a range of services and platforms which sets the standard in the United Kingdom and internationally. Its services should be distinctive from those provided elsewhere and should take creative risks, even if not all succeed, in order to develop fresh approaches and innovative content.”

Sharing your personal data

The 大象传媒 works with our approved third-party providers who help us to provide some of our services. These partners only use your personal data on behalf of the 大象传媒 and not independently of the 大象传媒.

We may share personal data with a third party where required or permitted by law.

Retaining your personal data

We will retain your contribution for up to two (2) years during which we may contact you to use your contribution for our programmes. If we have not contacted you your contribution will be automatically deleted by the 大象传媒 after the two (2) years.

If your contribution is used for broadcast, the broadcast will be retained and archived in perpetuity by the 大象传媒.

Your personal data will be stored in the UK and the EEA.

Your rights and more information

You have rights under data protection law:
• You can request a copy of the personal data 大象传媒 stores about you.
• You have the right to ask for the personal data we collect about you to be deleted, however there are limitations and exceptions to this right, which may entitle the 大象传媒 to refuse your request.
• You have the right to rectify any inaccurate or incomplete personal data that we hold about you.
• In certain circumstances, you have the right to restrict the processing of your personal data or to object to the processing of your personal data.
• You have the right to ask that we transfer the personal data to you or to another organisation, in certain circumstances.
