Every day this week there seems to have been a big story in the news about the relationship between openness and personal privacy.

Tonight David Grossman will be investigating what we听should听be allowed to know, and we'll be joined by a panel including actor Hugh Grant, Spectator editor Fraser Nelson, lawyer Charlotte Harris, and former prostitute Helen Wood who was embroiled in a sex related super injunction herself, to debate privacy laws, super injunctions and Twitter revelations.

Then historian and author of England's Mistress, Kate Williams will be asking why all these affairs have at their core older married men and younger attractive women - what does this tell us about 21st Century sexual behaviour in Britain?

    You cannot legislate for integrity, it ARISES from mature, 'whole' being.

    Why isn't David Laws going to jail?

    He wrongly claimed over 拢40,000 in expenses since 2006 and didn't repay it until he either came out or was forced out when his homosexual relationship was about to appear in the Daily Telegraph in 2010.
    There were also some interestingly creative property house deals with and for his male friend.

    Others got jail for less money. Why not him?

    Could be part of a larger debate about the Human Rights of individuals 鈥 versus - what is in the best interests of our society, which has degenerated to the point where we have little right to persuade other nations and cultures to adopt 鈥榙emocracy鈥 - as we know it.

    Last night鈥檚 鈥楾onight鈥 (ITV) dealt with cases where the HRA1998 (as interpreted by learned lawyers and judges) defied common sense and the rights of society.
    The cases of violent criminals, murderers, rapists and paedophiles being released into our society because of 鈥榯heir right to family life鈥, etc., are well known to most of us. Yet some contributors attempted to cite cases where the HRA protected the vulnerable.

    HRA, by focussing on Individual Rights, has devalued the Rights of Society and ignored the Responsibilities of all members to a society. Although Cameron has confirmed his belief that a Bill of Rights is required (that will hopefully redress this important issue) I believe his review team is heavily loaded with the status quo lefty liberals.

    I am presently fighting a battle about the degeneration of discipline (in a faith school) which turns a blind eye on disruptive pupils and believes it can reform even those pupils with criminal records. I鈥檒l have more on this later; meanwhile I believe that the right to privacy of an individual should not be paramount over the right of the public in cases where society is affected or put at any risk. Although I have no interest in the misdeeds of 鈥榗elebs鈥 there should be disclosure and penalty in cases where they hold public office or are represented as role models for our baffled youth.

    If Hislop dares. He does have limits to his courage - the Conservative Party can be a no-go area, to my certain knowledge, so it might spill over into Laws' Law.

    The Minster Monster is a powerful beast. Under it aegis, Dave's Tories might prove as nasty as he is. That NO Campaign was enough to frighten the stoutest of yeomen.

    I read a report this week of a doctor who was charged with dangerous driving -resulting in an accident that killed another driver. The Judge gave the doctor a non-custodial sentence on account he had an important job. Thats how it works. There really is one law for some and another law for others.
    I was up in front of a magistrate some years ago for a speeding offence. I was advised by a friend whom happened to be a magistrate and a freemason. He told me to give a certain signal with my hands and a comment of submission in a certain manner. I got off with the speeding offence. Thats how it works. Furthur up the food chain the rules of the game are played somewhat different.

    I generally look to the non-politicians for some un-whipped perceptiveness and balance. O'Brien's righteous, gratuitous vitriol, put him firmly in the Dave Zone. I suppose he is seen as 大象传媒-edgy.

    I wonder what skeletons might be tapping on the door of HIS cupboard? That can make a chap over-compensate.

    Regarding the privacy and superinjunction issue, you just cannot legislate for what people might write on Twitter or Facebook. A great many of them are humble folk in any case so its no good suing them as they might concevably be men and women of straw but since when has there been a law against poverty. No, this is a battle between the rich and the even richer. If A N Celeb (rich person) sues the even richer Daily GetsEvenWorse then the Daily GetsEvenWorse will pay up. What I do object to is that we are using a load of judge time and judicial resources to do this thing, rather than using judges incredible intellect on real law. Its all about which celeb has had their feelings injured and this is daily fare within the media industry. The real news is that poor people have feelings too and its their plight with which we should be concerned.

    That surely depends on what you mean by real law, your Honour.

    Although I agree with your main point, my gripe is that judges鈥 incredible intellect seem to be used more on studying and applying the minutiae of the wording of legislation than on dispensing fair and just judgements 鈥 with particular regard to the needs of society rather than exclusively those of the individual - too often the offender.

    With regard to other judicial resources, whilst it is accepted that prosecuting and defending counsel will use any means to win their case (and their fees) judges should surely look beyond the wording of a piece of legislation, often poorly drafted, or without being fully tested and trialled on a full range of circumstances that may not have been anticipated at the drafting and enactment stages. Case law seems not to be developing in the many cases that now seem to hinge on the one-sided Human Rights Act.

    Another current issue regarding the use of 鈥榡udicial resources鈥 is the judgement against Network Rail, which appears to result in a fine of 拢3million being paid out from public funds and into...where? The only winners will again be the army of legal eagles who have argued for and against the judgement.

    LEFT BRAIN LAW - RIGHT BRAIN JUSTICE (#15)

    If you have the right mentality (quasi OCD/autistic) there is a visceral thrill to be had with language - the more (seemingly) precise, the greater the thrill. Patent writing takes one into this surreal realm, and I suspect law is similar. Justice, on the 'other hand', should be a million miles away from such rigidity.

    It has been shown, repeatedly, that men and women censure their own and opposite genders DIFFERENTIALLY. Sexual offence cases are a particularly interesting area of study.

    But law is about 'tidying away'; justice is about humanity. Law is coupled with retribution, justice with amelioration. The immature tend to law; the wise to justice.
    In this Age of Perversity, justice must wait; and will wait a long time if Westminster is any template.

    I generally fly the Kelvin Mackenzie flag but Hugh Grant made a good case against the manner in which our daily tabs operate. I don't always buy into that often said 'we have the right to know' line. 'News'papers increase their sales with these torrid reports: an actor has a knee trembler with a hooker, a football player pays for sex etc. It can be argued that envy plays a part in the uproar against these super injuctions: the rich and famous have more opportunity to indulde, they have the means etc..is this just collective jealousy from our tabloid press and the usual need for increasing circulation?
    I've never paid for sex - the wife, her sister and the mistress wouldn't be impressed if I tried but I'm sure 拢50-拢100 can get a man a good time..we only ever need about half an hour at most, so you don't have to be rich to 'have some fun' and it can all be done in a lunch hour.
    The hacks get good juicy stories whilst getting a bit of action on the side themselves then go all sactimonious with piety whilst trotting out these sex stories. The real sad part in all this is that people would actually be interested in these stories...whats even sadder is that there are job descriptions such as media lawyers..and -as always -the real winners in all of this.

    Huge Grant has given a good account for the right to privacy, and has therefore forced me to rethink on this issue, an issue I didn't even give much thought to anyway. Still, I've never seen a film that he's been in that I liked...but that's just me.

    A good news story: Dave Gilmour performed with Rogerwaters at the O2 whilst performing the Wall this week. Now thats the kinda story I like to hear. That and Man City bring home a cup (I live in hope)

    What a depressing Fri 13th. The new blog format is a travesty. It breaks my heart to see Watriler couped up in a box and Bluesberry's polemic chopped within a sentence of existence. Battery-farming the public intellect!

    If the contagion spreads to the daily commentary I shall sorely miss the characterful, sometimes elegaic and sometimes persuasive, rhetoric, rants and rambles. The mod-costs could so easily have been swallowed by returning all, but the truly sinister abuses of, freedoms of speech.

    Gramsci must be twitching at the news of such a coup d'articulation. The new look is crisp and professional and, just in case the content isn't, hegemony has been restored via in-house software (harshtread).

With no hint of local residents receiving compensation, the windfarm manufacturers see no hypocrisy in appealling to the Council's duty to provide renewable energy, essentially, as a *public* good.

    Get the feeling that there will be a split in the US military and a powerful faction will act if the $ looks like its going to hyperinflation or another crazy false flag op gets switched on and the same policies and banker employees are in place.     The on-going tragedy of people dying in search of protection is a shame to Europe's civil conscience. These deaths are not isolated incidents.     @50 Barrie - speaking as a proud - or perhaps grateful - mongrel, I have a different point of view. :-) There is a town, about half an hour far from where I live, which a friend described as "so inbred, that even the dog has a club foot". I thought this was a cruel if amusing joke, until I read about the plight of the red squirrels of Anglesey, where due to inbreeding, the animals are being born with "missing or severely deformed feet".



    My mother came to the UK as a refugee in 1946. She started as a nanny, sponsored by a Quaker family in Cumberland. She progressed via cleaning toilets in hospitals, being a clerk, translator and interpreter, eventually teaching in Durham university. She got on extremely well with my dad's northern working class family, and was always grateful to, and fiercely defensive of, her adopted country.

    In my youth, Middlesbrough, where I was brought up, had all sorts, including Poles, Jews, Italians (Chris Rea), Welsh Irish, Scots, as well as the local population. The biggest employer was ICI, founded by Ludwig Mond.

    You need a bit of variety to spice things up. Generally in Pembrokeshire the women are noted for seeking mates from elsewhere, who then integrate with and enrich the local community.

    Of course, just because "some is good" does not necessarily imply that "more is better"; au contraire in many cases. The question is: how do we arrive at the right balance?

    From observation, I have the impression that 'mundane folk' all live within a set of lies called 'culture' and their (extreme) males tend to the Ape, when confronting difference - particularly en masse - particularly en alcohol.     Barrie - I agree "en masse" is a big problem - and can be big even without alcohol. In my experience women are just as bad as men. A good speaker, preacher, actor OR the right kind of football match can drown all rationality by inducing what Koestler described as a form of mass self-hypnosis, in which "the egotism of the group feeds upon the altruism of the individual".

    Such was clearly the case in the Nuremberg rallies, but I have been at quite a few events in my time where I have seen the mob mentality start to coalesce. Even if the mood is benign and not ugly it is very frightening to realise that people are being moved by a wave of emotion, and only a few will later hear "the still small voice of calm"*.

    multi-culturalism is the norm, and always has been in human society. Consider: What is the "culture" of the UK, or even just England?

    is it the fox-hunters, la-dee-da?
    is it the chavs, u wot?
    is it the politicians, "no, let me finish"?
    is it the traditional working class communities?
    is it the Sloane Rangers?
    Is it the crusties, the punks, the beat-niks, the ravers, the emos, the tabloid readers, the 大象传媒 viewers, the anti-fascists, the back-packers, the bobby-on-the-beat?

    can somebody please tell me which of these Cultures are the one we all have to become, please? Which of them are the "purest English"?

    and what about religion? Do we all have to become CoE, Protestants, Catholics, or Druids? What about the Buddhists, the Muslims, the Sikhs, the Atheists, the Jedi? Which of these are the most "English"? And what happens to those who don't like the choice forced upon us to conform?

    could it be the Liberalism that allows us to choose between these cultures and lifestyles *for ourselves* is more English than any of them separately? Of course, that freedom also allows some English to decide they DON'T LIKE OTHERS CHOOSING DIFFERENT THINGS TO THEMSELVES, they want to force others to agree with them. In a word, they are fascists. English culture allows people to choose that small-mindedness - *IF THEY WANT TO.*

    why? Because England is a LIBERAL NATION, and our grandparents, and THEIR parents fought for exactly those rights to choose. I think it is a pity some would like to drape themselves in "the flag", whilst trying to deny the very freedoms it stands for. But hey - that's their choice, right? A shame they don't have the MATURITY, (Barrie), to offer the same freedoms to others.

    it is Liberalism that requires maturity, any child/adolescent can get all steamed up about "purity", and the fascists historically are merely a bunch of hysterical fanatics led by hypocritical charismatics. Just like the various extremist Muslim/Christian/Jewish/Hindu/Buddhist extremist groups. Sooner or later, as mentioned in the documentary 'The Power of Nightmares', this quest for "purity" leads extremists to turn upon themselves. I just wish they'd *start* that way, and let the mature LIBERALS get on with normal, peaceful, co-existent day-to-day lives.

    Re multiculturism. Different cultures mean conflict - and cooperation. In the 1950s and 60s, in my home town like many others, it was the brown school uniforms v the rest. We lived side by side, but if a brown/purple school uniform went out with a green/blue school uniform, the priest would be knocking at the door, and maybe the minister too. I could give graphic horror stories of emotional blackmail and abuse, but what's the point? It would be the truth, but not the whole truth. It would ignore the friendship, goodneighbourliness and community spirit which transcended these divisions.

    In Wales we have conflict over the language issue. Feelings run high, and national myths based on a manufactured Celtic history don't help. And yet these myths also give dignity to the marginalised. The see-saw swings of power are settling down. We live together bitchily but fairly amicably on the whole, because Britain being Britain, we are who we choose to be anyway.

Although I am not formally religious now, I attended my local Friends Meeting in M'boro for many years. What they gave me was of immense value, and indeed helped make me who I am.
